State Liability Law

State liability law governs first and foremost the liability of public administration for unlawful action. In one of the largest departmental liability suits in the history of German law, our attorney, Dr. Thomas Burmeister, was the official in charge at the firm engaged by the accused state of Rhineland-Palatinate: because of an unlawfully granted partial nuclear license for the nuclear power plant Mülheim-Kärlich, the energy company RWE demanded damages in the billions.

Most recently, litigation due to damage from geothermal drilling in the city of Staufen has received nationwide attention. We are representing the state of Baden-Wuerttemberg in this case as one of the defendants before the court. In addition, we generally represent communities who find themselves exposed to state liability claims.
